I have been summoned to give a statement as a suspect, what should I do?
Before making any statement, speak to a lawyer. You have the right to legal assistance and not to incriminate yourself. Turning up prepared and advised from the outset shapes much of the proceedings.
A relative has been arrested, what can I do?
A person under arrest has the right to a lawyer from the very first moment, to be told the facts they are accused of, and to remain silent. It is best to contact a trusted lawyer as soon as possible; I also act in assistance to detainees.
When does a criminal offence become time-barred?
It depends on the seriousness of the offence and the penalty it carries, so it varies greatly from one case to another. It is a technical question worth examining in detail, because it can be decisive.
What is white-collar criminal law?
It is criminal law applied to the business and financial sphere: breach of fiduciary duty, misappropriation, fraud, corporate offences, punishable insolvencies or offences against the public treasury, among others. The line between a legitimate business decision and criminal liability is not always clear-cut.
When is it worth having a lawyer review a contract?
Before signing it. Reviewing a contract and anticipating the points of conflict costs far less than litigating later over a badly drafted clause.
My company is facing liquidity difficulties, what options do I have?
The sooner you act, the more options remain. There are pre-insolvency tools (such as the notice of opening of negotiations and restructuring plans) and, where appropriate, insolvency proceedings. Acting early often makes the difference.
What liability does a company director take on?
A director may be liable in civil and commercial terms towards the company, the shareholders or third parties and, in certain cases, criminally. That said, an informed decision, made in good faith and without a conflict of interest, does not become liability merely because it turns out badly (the so-called protection of business judgement, article 226 of the Spanish Companies Act).
What is the TAD and when do you go to it?
The Administrative Court for Sport is the body that rules, as the final administrative instance, on sports-disciplinary matters at national level. Its decisions can then be appealed before the administrative courts.
What is the CAS/TAS?
It is the Court of Arbitration for Sport, based in Lausanne, which resolves international sports disputes by arbitration.
